2. What these terms cover
These terms govern the sale of digital content – the e-book and the workshop recording – between the seller and the buyer. Matters not covered here are governed by Act No. 89/2012 Coll., the Civil Code, and, where the buyer is a consumer, also by Act No. 634/1992 Coll., on Consumer Protection.
By submitting an order, the buyer confirms that they have read these terms and agree to them.
3. What is sold
- E-book “Jak připravit dítě na první den školky. A sebe taky.” (How to Prepare Your Child for Their First Day of Preschool. And Yourself Too.) – an 83-page e-book in PDF, price 329 Kč.
- Workshop + e-book – a video recording of the workshop (42 minutes long) available online, plus the e-book in PDF, price 913 Kč.
In both cases this is digital content that is not supplied on a tangible medium. We do not send any goods by mail.
The content is informative and educational in nature. It does not replace medical, psychological or other professional care, and the seller is not liable for decisions the buyer makes based on it.
4. Ordering and contract formation
Orders are placed through the SimpleShop ordering and payment system. The buyer fills in the order form and submits it; before submitting, they can check and correct the details.
The contract is formed at the moment the seller confirms the order by email to the buyer. The contract is concluded in the Czech language and the seller archives it in electronic form.
5. Price and payment
- Prices are stated on the sales page and are final.
- Payment is made by card or bank transfer via SimpleShop; the available payment methods depend on what the system currently offers.
- The seller will send a receipt to the email address given in the order.
- The price is a one-time payment. It is not a subscription and nothing renews automatically.
6. Delivery of the content
The content is made available immediately after payment – it appears on the order confirmation page, and the seller also sends a link to the email address given in the order, within 24 hours at the latest.
- The e-book can be downloaded as a PDF.
- The workshop recording can be streamed online an unlimited number of times.
- The seller will keep the content available for at least 24 months from purchase. If it is discontinued earlier, the seller will give at least 30 days' notice so the buyer has time to download the content.
Technical requirements: an up-to-date standard web browser, an internet connection and a PDF reader. The seller is not responsible for the speed of the buyer's own connection.
If the email with the link does not arrive, the buyer should check their spam folder and then write to info@littlekidspisek.cz; we will send the link again.
7. Withdrawal from the contract
For contracts concluded at a distance, a consumer normally has the right to withdraw within 14 days. For digital content not supplied on a tangible medium, however, this right expires as soon as performance begins with the consumer's express consent – as provided by Section 1837(l) of the Civil Code.
In practice this means: in the order, the buyer checks a box confirming that they agree to the content being made available immediately after payment and that they thereby lose the right to withdraw from the contract. Without this consent, the content cannot be made available earlier than after 14 days. The buyer receives confirmation of this consent by email together with the access.
The right to withdraw remains in place for as long as the seller has not made the content available.
After the content has been made available, there is therefore no formal entitlement to a refund. If the buyer nevertheless feels that the content does not match what is described on the sales page, they should write to info@littlekidspisek.cz – we will work something out.
8. Defects and complaints
Rights arising from defective performance are governed by Section 2389a et seq. of the Civil Code. The seller is responsible for the content being free of defects when made available and matching the description on the sales page.
A defect is, for example, a broken link, a corrupted file, a video that cannot be played, or content that does not match the description. It is not a defect if the reader disagrees with the authors' views or if the advice does not work in their particular situation.
The buyer can submit a complaint by email to info@littlekidspisek.cz or via the contact form, describing the fault. The seller will handle it as soon as possible, within 30 days at the latest, and will inform the buyer of the outcome by email. The preferred remedy is removing the defect (by fixing it or by making the content available again); if that is not possible, the buyer may request a reasonable discount or withdraw from the contract.
9. Copyright
Both the e-book and the workshop recording are copyrighted works protected by Act No. 121/2000 Coll., the Copyright Act. The buyer may use them solely for their own personal use.
- The content must not be copied, distributed, published, sold or otherwise made available to other people.
- The link to the content is personal and must not be shared.
- In the event of a breach, the seller may cancel access without compensation; this is without prejudice to claims under the Copyright Act.
10. Out-of-court dispute resolution
A consumer has the right to out-of-court resolution of a consumer dispute under Section 14 of the Consumer Protection Act. The competent body is the Česká obchodní inspekce (the Czech Trade Inspection Authority), Štěpánská 796/44, 110 00 Praha 1, adr.coi.cz.
Before filing a formal complaint, though, we would appreciate it if the consumer contacted us first – we resolve most matters by email within a few days.
11. Personal data
How we handle buyers' personal data is described in our Privacy Policy.
12. Final provisions
- These terms are governed by Czech law. Czech courts have jurisdiction over any disputes.
- The seller may amend these terms; each order is governed by the wording effective at the moment it is submitted.
- If any provision is invalid, the remaining provisions remain in effect.
